For my clients and friends that don’t recognize the term “BAPCPA”, above, it is the acronym for the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005. These amendments to the Bankruptcy laws have presented many challenges for consumer debtors, bankruptcy lawyers and trustees. One of the changes in the law was recently reviewed by the United States Supreme Court in a new opinion that interprets the effects of the “Means Test” on the budget expenses allowed for Chapter 13 debtors. That case is Ransom v. FIA Card Services.
We can expect this area of law to continue to challenge debtors seeking to legitimately restructure or discharge their debts. Bankruptcy will remain a necessary step for many consumers and one that should only be taken with expert counsel.
